NSW sentencing reform

Sentencing reform has commenced in NSW, see a summary of changes here.

The key changes are :

  • Courts have better information about offenders at time of sentencing
  • Overhaul of the Intensive Correction Order
  • Abolition of suspended sentences
  • There is a presumption that domestic violence offenders receive a supervised community-based sentence or are imprisoned, unless there are clear reasons why another sentence would be more appropriate
  • More offenders at risk of returning to crime are subject to supervision and programs to address offending behaviour

Amendments to the Crimes (Administration of Sentences) Act 1999 (NSW) and Crimes (Sentencing Procedure) Act 1999 (NSW) came into effect 24 September 2018.
